Terms of Service, Terms of Use and Purchase Terms — "The Bottom Line"

1. General
This website (the "Site", at thebottomlinebook.net) is operated by Dr. Vladi Dvoyris (the "Site Owner" / "we") and is used for the sale of the book "The Bottom Line" in printed and digital editions, as well as for marketing lectures and meetups.

These terms are written in the masculine form for convenience only and refer to all genders equally. Singular includes plural and vice versa.
The headings in these terms are for convenience only and shall not be used to interpret the terms.
By using the Site and/or making a purchase, you fully agree to all terms herein. A user who does not agree to any term is requested to refrain from using the Site and making purchases.
2. Eligibility to Purchase (Age Restriction)
A prerequisite for making a purchase on the Site is that the purchaser is 18 years of age or older, has legal capacity to commit to a transaction, and holds a valid credit card registered in their name (or appropriate authorization to use one).
A purchase by a minor under 18 requires parental or guardian consent. By completing a purchase, the purchaser declares that they meet these requirements.
3. Products and Prices
The following editions of the book are sold on the Site (prices include VAT):
- Printed Edition — ₪95. Shipped within Israel only.
- Digital Edition — ₪50. epub or PDF file, available for immediate download after payment.
- Printed Edition with Personal Dedication by the Author — ₪115. Dedication available in Hebrew, English, or Russian; shipped within Israel only.
- Printed + Digital Bundle (discounted) — ₪119. The printed book is shipped within Israel only; the digital version is available for immediate download.
The book is also available through independent third parties, including the digital bookstore E-vrit and Amazon for international shipping. Such purchases are subject to the terms of use and cancellation/shipping policies of those parties, and are not subject to these terms.
The Site Owner may update the product range and prices at any time without prior notice. The binding price is the one displayed on the Site at the time of completing the order.
Promotions and discounts (such as coupon codes) may be offered for a limited period under terms published from time to time. The Site Owner may terminate or modify a promotion at any time.
Should a typographical error or obvious pricing error appear in a product description or price, such error shall not be binding on the Site Owner, who shall be entitled to cancel the order and refund any amount paid.
4. Placing an Order and Payment
Orders are placed through the ordering system on the Site. Completing an order requires providing complete and accurate details, including name, email address, and for printed products — a shipping address.
Payment is made by credit card through the payment processor Grow, in a secure environment. The Site Owner does not store credit card details.
An order is considered confirmed only upon receipt of credit card company authorization. Order confirmation will be sent to the email address provided by the customer.
The Site Owner may decline to approve an order, including in cases of stock shortage, credit card authorization failure, or suspicion of misuse. In such cases the order will be cancelled and no charge will be made (or any charge already made will be refunded).
5. Terms Confirmation on the Payment Page
Completing a purchase on the Site is conditional on checking a confirmation checkbox on the payment page, in which the customer confirms that they have read these Terms of Service and Purchase Terms, and that they agree to them.
The confirmation checkbox includes a direct link to view these terms in full, allowing the customer to review them before completing payment.
6. Product Supply and Shipping Policy
Digital products. The digital book (epub / PDF) is available for immediate download immediately after payment is completed and confirmed. No shipping fee applies.
Printed products. Printed books are dispatched within 1–5 business days of order confirmation. Shipping is within Israel only; to ship a printed book internationally, please use the Amazon purchase option.
Shipping options and fees for printed books:
- Self-pickup (Petah Tikva) — Free. Pickup time will be coordinated with the customer.
- Locker / nearby pickup point — ₪30.
- Courier to door — ₪50.
Delivery times stated are estimates and refer to business days only. The Site Owner is not responsible for delays in shipping carried out by a third party (Israel Post, courier company, locker company, etc.) caused by circumstances beyond its control, including force majeure, strikes, lockouts, security situations, or failure by the customer to respond for coordination or delivery purposes.
It is the customer's responsibility to provide accurate shipping details. Delays or failed deliveries resulting from incorrect details provided by the customer are not the Site Owner's responsibility, and additional shipping fees may apply.
7. Cancellation and Refund Policy
Order cancellation is subject to the provisions of the Consumer Protection Law, 5741-1981, and regulations thereunder, as detailed below.
Printed book. The purchase may be cancelled within 14 days of receiving the product or receiving the transaction details document, whichever is later. Cancellation must be made in writing to vladi@dvoyris.com (or by phone as listed in section 1.2), stating the customer's name and order number. The product must be returned in its packaging, intact, without any damage or defect. Return shipping is the customer's responsibility and at the customer's expense. Returns of books with signatures or dedications will not be accepted.
Cancellation fee. For cancellations not due to a defect or non-conformity, the Site Owner may charge a cancellation fee of 5% of the product price or ₪100, whichever is lower. The refund will be processed within 14 days of receipt of the cancellation notice and return of the product.
Digital book. Under the law, a transaction for a digital product / "information" (a file available for download, reproduction, or copying) cannot be cancelled after the file has been made available to the customer for download. Completing a purchase of a digital edition constitutes agreement that the right of cancellation does not apply to it.
Book with personal dedication. A book including a personal dedication is a product created specifically for the customer, and therefore, under the law, the right of cancellation does not apply (except in the case of a defect or non-conformity).
Defective product or non-conformity. If a defective, damaged in transit, or non-conforming product is received, the customer should contact vladi@dvoyris.com within a reasonable time, and the Site Owner will repair, replace, or credit the customer as appropriate and in accordance with the law. This right does not derogate from the customer's statutory rights.
The Site Owner may cancel an order as described in sections 3.5 and 4.4, with a full refund of any amount paid.
8. Liability and Limitation of Liability
"The Bottom Line" is a literary work — a personal memoir. Its contents reflect the author's personal experiences, memories, and opinions, and do not constitute factual truth, professional advice, or professional opinion — medical, psychological, legal, or otherwise. The content of the book should not be relied upon as a substitute for appropriate professional advice.
The Site Owner and/or anyone acting on their behalf shall not be liable for any direct and/or indirect damage caused as a result of the use of the book, its contents, or any service purchased on the Site. Responsibility for the use of the information and content lies with the user alone.
The book deals with difficult content relating to the events of October 7, 2023 and the casualty identification process. Reading is at the reader's own risk and discretion.
The Site Owner makes every effort to ensure the information on the Site is accurate and up to date, but is not responsible for errors, inaccuracies, or technical malfunctions, and does not guarantee continuous availability of the Site.
In any case, the Site Owner's liability to the customer shall not exceed the amount actually paid by the customer for the relevant product.
9. Intellectual Property
All rights in the book and its contents, including the text, cover, images, design, trademarks, and all other content on the Site — are reserved to the Site Owner and/or the relevant rights holders.
It is prohibited to copy, reproduce, distribute, broadcast, publish, or make any commercial use of these contents, in whole or in part, without prior written consent from the Site Owner. Purchase of the digital book grants a personal-use license only and does not permit distribution or copying.
10. Privacy
Use of the Site and purchasing on it are also subject to the Site's Privacy Policy, available at: thebottomlinebook.net/privacy.
11. Miscellaneous and Jurisdiction
These terms and all matters arising from use of the Site and purchases on it shall be governed solely by the laws of the State of Israel.
Exclusive jurisdiction over any dispute shall be vested in the competent courts of the Central District only.
If any provision of these terms is determined to be invalid or unenforceable, this shall not affect the validity of the remaining provisions.
The Site Owner may update these terms from time to time. The binding version is the one published on the Site at the time of making the purchase.
